What is Rental Restrictions?

Rental restrictions are covenant provisions limiting how owners may lease their homes — through caps, minimum lease terms, registration requirements, or short-term rental bans.
Common structures include a percentage cap on rented units with a waitlist, a minimum lease term (30 days, six months, or a year) that effectively bars short-term rentals, mandatory lease registration and tenant contact information, and owner-occupancy waiting periods after purchase.
Rental caps often exist for financing reasons: Fannie Mae, Freddie Mac, and FHA project approvals consider owner-occupancy ratios, and communities that tip too far toward rentals can find buyers unable to obtain conventional loans.
Amending documents to add rental restrictions frequently requires a supermajority and, in some states, grandfathering of existing landlords.
