What is Delinquency?

Delinquency is an owner's unpaid assessment balance past its due date, triggering the association's collection policy.

Most associations adopt a written collection policy defining when an account is delinquent, what late fee and interest apply, when a demand letter goes out, when privileges are suspended, and when the matter goes to counsel or a collection agency.

Consistency is critical. Waiving fees for some owners and not others exposes the board to selective enforcement claims and undermines collections generally. The policy should be applied the same way every time, with hardship handled through a documented payment plan rather than informal exceptions.

High delinquency rates hurt everyone: they force budget cuts, drain reserves, and can jeopardize lender approval for the entire community.
