What is Open Meeting Requirements?

Open meeting requirements are state-law rules obligating boards to conduct association business at noticed meetings that owners may attend, with limited exceptions.

Most states with HOA statutes require that board meetings be noticed in advance, open to owners, and documented in minutes. Deciding business over email or in an unnoticed gathering can make the action voidable and is one of the most common owner complaints.

Executive session is the exception. Boards may typically close a portion of the meeting for personnel matters, pending or threatened litigation, contract negotiation, and individual owner delinquency or disciplinary hearings — but the fact that an executive session occurred, and its general subject, usually must be noted in the minutes.

Many statutes also give owners a right to speak during an open forum portion, subject to reasonable time limits.
