What is Fines?

Fining authority is not automatic. It must be granted by the governing documents or statute, and most states require a written schedule of fines, advance notice, and a hearing opportunity before a fine becomes enforceable.

Fines are often capped per violation and per day for continuing violations. Some states expressly prohibit associations from foreclosing on a lien composed solely of fines, even where assessment liens are foreclosable.

Consistency is again the risk point: fining one owner for a condition tolerated elsewhere in the community is the textbook selective enforcement claim.
